Even if the nation dies at first turn, it has a player slot assigned. For lua scripting purposes I'd rather be consistent about existence of that slot on animals > 0 games -> keep current behavior.

Whether any animal units get created at game start depends on generated terrain and chance. It's possible no units get created.

I've provoked this easily with "/set animals 1". There's a non-zero chance of it happening even with more sensible settings.

Currently what seems to happen is that the Animal nation is immediately dead in the first turn, which isn't a terrible outcome. I don't know if that's robust though. Perhaps we should just wipe the nation during game setup if it doesn't accrue any units (similar to what we do with "/set animals 0", which is not to create the nation at all).
